HARMONISATION OF LEGAL REGULATION OF TECHNOLOGY TRANSFER IN UKRAINE WITH THE EU ACQUIS: THEORETICAL, LEGAL, AND INSTITUTIONAL DIMENSIONS

Abstract. This article presents a comprehensive theoretical, legal, and institutional analysis of the adaptation of Ukrainian legislation in the field of technology transfer to European Union law within the context of European integration processes and the formation of an innovative economy. The paper examines the regulatory foundations for the functioning of the technology transfer system in Ukraine, the peculiarities of harmonising national legislation with the EU acquis, and the impact of European approaches on the development of mechanisms for the commercialisation of research and development (R&D) results.
The role of intellectual property rights, digitalisation, innovation infrastructure, and scientific and technological cooperation in ensuring effective technology transfer between the state, research institutions, higher education institutions, and the business sector is analysed. Particular attention is paid to the implementation of the provisions of the Association Agreement between Ukraine and the European Union, as well as European strategies in the field of innovation, research, and technological development.
As a result of the study, the key problems of adapting Ukrainian legislation in the field of technology transfer are identified, including the fragmentation of regulatory frameworks, an insufficient level of institutional coordination, the limits of commercialisation mechanisms for intellectual property subject matter, and a low level of integration between science and business. The need to improve the national model of technology transfer management in accordance with European standards of open science, the innovation ecosystem, and technological partnership is substantiated.
Directions for modernising Ukrainian legislation are proposed, taking into account the principles of legal certainty, technological neutrality, digital transformation, and the development of international scientific and technological cooperation. The practical value of the study lies in the possibility of using its results for the further improvement of state policy in the field of technology transfer, innovation activity, and Ukraine’s integration into the European Research Area.
