INTELLECTUAL PROPERTY AS AN ECONOMIC ASSET IN THE SYSTEM <\/strong>OF DIGITAL TRANSFORMATION<\/strong><\/p>\n

Abstract.<\/strong> This article explores the theoretical-legal and economic aspects of intellectual property (IP) functioning within the context of the digital transformation of the economy. The authors define the role of intellectual property items as strategic intangible assets in shaping an innovative economy, developing digital markets, fostering technology entrepreneurship, and facilitating technology transfer. The study analyzes the current state of legislative support for the IP sphere in Ukraine and outlines key directions for harmonizing national legislation with European Union law.
\nThe study highlights European mechanisms for digital copyright protection, the commercialization of scientific research results, the functioning of digital platforms, and policy tools supporting innovative enterprises. The authors substantiate the necessity of adapting these EU legal frameworks to the Ukrainian legal system to foster institutional growth.
\nFurthermore, the paper demonstrates the expediency of integrating specific European legal mechanisms into the national IP regulation framework. The investigation focuses particularly on the spheres of digital licensing, text and data mining, the use of artificial intelligence (AI), and the operational optimization of online platforms and digital services.
\nParticular attention is given to the challenges of legal regulation of intellectual property objects created using artificial intelligence technologies, as well as to the challenges of ensuring a balance between protecting the rights of rights holders and the needs of developing digital innovations. Prospects for forming a modern digital ecosystem for managing intellectual property in Ukraine, integrated into the European innovation space, are defined.<\/p>\n
