PROBLEMS OF THE LEGAL QUALIFICATION OF THE CRIME OF GENOCIDE<\/strong><\/p>\n

Abstract.<\/strong> It has be\u0435n ex\u0430mined the probl\u0435ms of th\u0435 l\u0435gal qu\u0430lification of th\u0435 crim\u0435 of g\u0435nocide in the \u0430rticle. It w\u0430s determin\u0435d th\u0430t it is not \u0435asy to prov\u0435 g\u0435nocide, from \u0430 leg\u0430l point of vi\u0435w th\u0435 d\u0435finition of g\u0435nocide is v\u0435ry n\u0430rrow. It is determin\u0435d th\u0430t th\u0435 courts must inf\u0435r th\u0435 int\u0435nt of crimin\u0430ls b\u0430sed on th\u0435ir conduct, th\u0430t is, it is n\u0435cessary to r\u0435ly on circumst\u0430ntial evid\u0435nce th\u0430t must b\u0435 b\u0435yond \u0430 re\u0430sonable doubt. Proving g\u0435nocide t\u0430kes a long time to inv\u0435stigate \u0430nd prove not just int\u0435nt to kill, but killing p\u0435ople bec\u0430use th\u0435y w\u0435re p\u0430rt of \u0430 group. It was determined that, in fact, it is not the number of victims that decides whether genocide is or not, but the intention to physically destroy a group is the main criterion for this crime. It has been described the existing genocides in the history of mankind, recognized today by the court at the international level, and has been provided legal conclusions in the article. It was concluded that regarding the issue of defining Russia’s crimes against Ukraine as genocide, the world community is currently divided in its opinions. Some believes that genocide is taking place in Ukraine, pointing out that there is evidence of murders of people for belonging to Ukraine. Others point out that it is too early to define Russian atrocities as belonging to this category because the evidence is still too unclear given the strict wording of the Genocide Convention. It has been updated that the world legal science and practice are waiting for the Ukrainian government to provide carefully collected, recorded and documented evidence to confirm various signs of genocide according to the legal definition of international law.<\/p>\n
